If a national market regulator asks you for information about a product you distribute, you must provide it — documentation, records, test reports, whatever they need. You must also cooperate with any action they require to bring products into compliance, including recalls. Keep the relevant supply-chain contacts readily available so you can respond quickly.

Legal text

Article 20(5) of Regulation (EU) 2024/2847 provides that distributors shall, further to a reasoned request from a competent authority, provide it with all the information and documentation in paper or electronic form necessary to demonstrate the conformity of a product with digital elements with this Regulation, in a language which can be easily understood by that authority.

Distributors shall cooperate with that authority, at its request, on any action taken to bring the products which they have made available on the market into compliance with the requirements of this Regulation.

Key requirements

  1. Respond to requests — provide documentation and information requested by any competent authority in a member state where the product has been distributed
  2. Language — documentation in a language understandable by the requesting authority
  3. Full cooperation — assist with investigations and any required corrective action, including product recalls
  4. Supply chain traceability — maintain records sufficient to identify the manufacturer and importer to whom authorities can be directed

Evidence you may need

  • Log of authority requests and your responses
  • Contact directory for manufacturers and importers in your supply chain
  • Internal procedure for handling regulatory enquiries
