While products are in your warehouse, distribution network, or on their way to customers, you are responsible for keeping storage and transport conditions from compromising them. This is especially relevant for products with tamper-evident hardware security features, but applies broadly to ensuring physical integrity throughout the distribution chain.

Legal text

Article 20(3) of Regulation (EU) 2024/2847 provides that distributors shall ensure that, while a product with digital elements is under their responsibility, storage or transport conditions do not jeopardise its compliance with the essential cybersecurity requirements set out in Annex I or with any other applicable requirement of this Regulation.

Key requirements

  1. Appropriate storage — environmental conditions (temperature, humidity, physical security) suitable for the product type
  2. Secure transport — packaging and logistics procedures that maintain physical and cybersecurity integrity
  3. Tamper evidence — preserve manufacturer-applied tamper-evident markings
  4. Responsibility boundary — obligation applies while the product is under the distributor's care, from receipt through delivery

Evidence you may need

  • Warehouse and storage conditions policy
  • Logistics and transport handling procedures
  • Goods-in and goods-out inspection records
